PlotMind is a service operated by Nikoloz Imerlishvili ("I," "me," "my," or the "Operator"). These Terms of Service ("Terms") govern your use of the PlotMind website, tools, and AI generation services (the "Services").
By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms.
1.1. Eligibility: You must be at least 18 years old to use the Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years old.
1.2. Agreement: If you do not agree to these Terms, you may not access or use the Services.
2.1. Account Responsibility: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify me immediately of any unauthorized use of your account.
2.2. Accurate Information: You agree to provide accurate, complete, and current registration information.
2.3. Service Availability: I reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice, in my sole discretion.
You are free to use, distribute, modify, and commercialize the Outputs (e.g., in your indie games, stories, and media) without requiring attribution to PlotMind, provided your use complies with these Terms.
You grant me a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and display your Inputs and Outputs only for the limited purposes of:
4.1. Accuracy and Reliability: You acknowledge that generative AI is probabilistic and may produce content that is inaccurate, incorrect, or misleading ("hallucinations"). PlotMind is a creative tool, not a factual source.
4.2. Responsibility for Outputs: You are solely responsible for reviewing, editing, and verifying the accuracy and appropriateness of any Outputs before using them in any commercial or public context.
4.3. Potential Infringement: AI models are trained on large datasets. While I strive to minimize this, the Outputs may occasionally resemble or be derived from copyrighted material. You assume all risk and liability for any potential intellectual property infringement claims resulting from your use of the Outputs.
You agree not to use the Services to:
6.1. Pricing: All fees for subscriptions and paid services are posted on the PlotMind website and are subject to change upon notice to you.
6.2. Payment: You agree to pay all charges associated with your account, including all applicable taxes, using the payment method specified.
6.3. Refunds: All payments are non-refundable, except as required by law or as explicitly stated in a separate written agreement.
7.1. Termination by You: You may stop using the Services and terminate your account at any time.
7.2. Termination by Operator: I may suspend or terminate your access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms or engage in prohibited activities.
The services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. I make no warranty that (a) the services will be uninterrupted, secure, or available at any particular time or location; (b) the results of using the services will meet your requirements; or (c) the outputs will be accurate, complete, or free of infringement.
In no event shall the Operator, nor its agents or contractors, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any Outputs obtained from the Services; or (c) any unauthorized access, use, or alteration of your Inputs or Outputs. In no case shall the Operator’s total liability to you exceed the amount you paid to PlotMind in the twelve (12) months preceding the claim.
You agree to defend, indemnify, and hold harmless the Operator from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt (including but not limited to attorney's fees) arising from (a) your use of and access to the Services, including any data or content transmitted or received by you; (b) your breach of any term of these Terms; (c) your violation of any third-party right, including without limitation any right of privacy or intellectual property rights; or (d) any claim that your Outputs or the commercial use of your Outputs infringes the rights of a third party.
These Terms shall be governed and construed in accordance with the laws of Georgia, without regard to its conflict of law provisions.
I reserve the right, at my sole discretion, to modify or replace these Terms at any time. If a revision is material, I will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use my Services after those revisions become effective, you agree to be bound by the revised terms.
